                    MINUTES OF PUBLIC HEARING FEBRUARY 24, 2014
                        TOWN HALL, 542 LIBERTY STREET, Hanson, Ma.

  • CALL TO ORDER – 7:00 PM

II.     ACCEPTANCE OF MINUTES

Minutes of January 27, 2014 and February 10, 2014 will be voted on at next meeting.

III.    APPOINTMENTS

FORM A/ANR – AHMED BARAKAT – MAIN STREET

The Board voted to approve the A/ANR revised Plan submitted by Mr. Barakat, prepared by Coneco Engineers, Scientists and Land Surveyors, 4 First Street, Bridgewater, Ma., labeled PLAN OF LAND, Main Street, Hanson, Ma., and dated 2/11/14, numbered 7005.

IV.     PUBLIC HEARING – 7:15 PM -  MEDICAL MARIJUANA FACILITIES

Public Hearing to review a proposed article for Annual Town Meeting to see if the Town will vote to amend the Hanson Zoning By-law by adding Section VI.L- Special Requirements for Medical Marijuana Facilities for the purpose of allowing and regulating the location of these facilities in the Town of Hanson.

Chairman Ellis made note that the Hanson Police Chief was invited to this hearing.  Although he did  not attend, the Town Planner indicated that he was fine with the proposal.  The Planning Board was in agreement with the proposed draft.
Motion to approve the draft for Medical Marijuana Facilities by adding Section VI.L and to put forth for the Annual Town Meeting:  Joseph Weeks

        PUBLIC HEARING – 7:45 PM- SIGN BY LAW

Public Hearing to review a proposed amendment to the Zoning By-laws to delete in its entirety the existing Section VII.E. – Signs of the Town of Hanson, County of Plymouth, Ma., Land Use Regulations Zoning By-law, amended October 2007 and accept in its entirety a new Section VII.E. Sign By-law dated February 25, 2014 on file in the office of the Town Clerk.

Chairman Ellis had some changes to Page 5-6 – F.-Real Estate Signs – “Such signs may be single or double-faced and are limited in size to 3 square feet or less” – change to – “Such signs may be single or double-faced and are limited to 6 square feet –“.
Also under F. – Real Estate Signs – Change second sentence of first paragraph to read –“Only one real estate sign and one open house sign is permitted to face on each street adjacent to the property.”
Motion made to change Article 2. – Exempt Signs – letter F. – Real Estate Signs – to read –“such signs may be single or double-faced and are limited in size to 6 square feet or less”---Motion made to add  “only one real estate sign and one open house is permitted to face on each street adjacent to the property” in Article 2.- Exempt Signs , letter F.-Real Estate Signs:  Patricia Glenn

Article 7. -  Sign Maintenance and Abandoned Signs – Section 2. – Abandoned and Unsafe Signs – in first paragraph add the following sentence to the end:  “The supporting structure is not required to be removed.”
Motion made to amend  Article 7. Section 2 – to add “the supporting structure is not required to be removed” to the end of the first paragraph:  Joseph Weeks

On Page 6 – Article 2.-Exempt Signs – letter L.-Farms Stands – delete in second sentence “be located on the same lot as the farm stand”.

        PUBLIC HEARING – ADULT ENTERTAINMENT OVERLAY DISTRICT – 8:15 PM

Public Hearing to review a proposed amendment to the Zoning By-laws to delete in its entirety the existing Section VI.J.3 – Adult Entertainment Overlay District of the Town of Hanson, County of Plymouth, Ma., Land Use Regulations Zoning By-law amended October 2007 and accept in its entirety a  new Section VI.J.3 – Adult Entertainment Overlay District dated January 27, 2014 on file in the office of the Town Clerk.
PROPOSED BY-LAW – ADULT ENTERTAINMENT OVERLAY DISTRICT
The Adult Entertainment Overlay  District is herein established as an overlay district.  A Plan entitled “Proposed Adult Entertainment Overlay District Plan”  prepared  by Land Planning, Inc. of Hanson, Ma., is on file in the office of the Town Clerk delineating this district and is hereby part of this By-law.
Motion made to amend the zoning by-law to accept the new proposed Adult Entertainment Overlay District:  Patricia Glenn

        PUBLIC HEARING – ADULT ENTERTAINMENT USES – 8:25 PM

Public Hearing to review a proposed amendment to the Zoning By-laws to see if the Town will vote to amend Section VI.J.5.c, Adult Entertainment Uses  by Special Permit Criteria of the Town of Hanson, County of Plymouth, Ma., Land Use Regulations Zoning By-law, amended October 2007 and accept an amended Section VI.J.5.c Adult entertainment Uses by Special Permit Criteria on file in the office of the Town Clerk.

        SUMMARY
This amended By-law will increase setback distances from the nearest adult entertainment use from a distance of five hundred (500) feet to one thousand (1,000) feet and decrease the setback of Adult Entertainment use from the nearest residential zoning district from one thousand (1,000) feet to a setback requirement of five hundred (500) feet from the nearest residential zoning district.
